The Federal High Court in Abuja has fixed June 30 to deliver a ruling on an application filed by Omoyele Sowore seeking to overturn the revocation of his bail and the bench warrant issued against him.
Justice Mohammed Umar fixed the date after hearing arguments from Sowore’s legal team and counsel representing the Department of State Services (DSS).
Until the ruling is delivered, the African Action Congress (AAC) presidential candidate will remain at the Kuje Correctional Centre.
Defence challenges bail revocation order
Sowore’s lawyer, Raphael Adakole, asked the court to set aside the order made on June 16 that revoked his bail and issued a bench warrant over his failure to appear in court.
The lawyer argued that the court should restore the previous conditions of the case and allow Sowore to continue enjoying his bail.
Adakole said the application was supported by an affidavit and legal arguments urging the court to consider the circumstances surrounding the matter.
DSS opposes Sowore’s request
However, counsel to the DSS, Akinkolu Kehinde, opposed the application.
The senior lawyer argued that Sowore had not presented enough facts to justify the court granting the request.
The DSS filed a counter-affidavit and urged the court to reject the application.
After listening to both sides, Justice Umar adjourned the matter for ruling.
Court declines immediate release request
Following the adjournment, Sowore’s lawyer requested that he be released to his legal team pending the ruling.
The request was opposed by DSS counsel, who argued that such an application should not be made verbally.
Justice Umar declined to make any immediate decision and maintained the earlier adjournment date.
Background of Sowore’s case
Justice Umar had earlier ordered Sowore’s remand at the Kuje Correctional Centre after revoking his bail.
The court also issued a bench warrant after he failed to appear for his trial.
Sowore is being prosecuted by the DSS over allegations linked to statements he made about President Bola Tinubu on his social media accounts.
